Closing Attorneys & Title Insurance

Understanding the Closing Process

Closing is the final step in a real estate transaction, but there is a great deal that happens behind the scenes before you arrive at the closing table.

In Georgia residential real estate transactions, licensed attorneys handle the closing process. The closing attorney helps ensure that the required legal documents are properly prepared and executed, that the transaction is handled according to applicable requirements, and that the appropriate funds and documents are properly distributed and recorded.

At Mavis Lane Realty, we understand that the legal and title portions of a real estate transaction can sometimes feel complicated. Our role is to help you understand what to expect and to work closely with the other professionals involved in your transaction.

The Role of the Closing Attorney

Georgia is an attorney-closing state, which means that a licensed Georgia attorney handles the residential real estate closing.

When a lender is involved in the purchase, the closing attorney technically represents the lender. This is an important distinction for buyers and sellers to understand.

At the same time, the closing attorney has responsibilities relating to the proper handling of the transaction for all parties. This includes matters such as the preparation and handling of deeds, recording documents, and the proper disbursement of funds.

The closing attorney is responsible for the legal aspects of the closing, while your Realtor remains focused on representing your interests within the real estate transaction and helping you navigate the buying or selling process.

Understanding who is responsible for each part of the transaction can make the entire experience easier and less confusing.

Title & Ownership

When you purchase real estate, you are not simply buying a physical property—you are also acquiring legal rights to that property.

A title search is an important part of the closing process because it helps identify matters that may affect ownership of the property. These can include prior liens, claims, recording issues, or other matters associated with the property’s title.

The goal is to identify and address title issues before the transaction is completed whenever possible.

For buyers, understanding the condition of the title is an important part of purchasing with confidence. For sellers, properly addressing title requirements can help prevent unexpected issues from delaying the closing.

Title Insurance

Title insurance is designed to provide protection against certain covered title-related risks.

Unlike many types of insurance that protect against future events, title insurance primarily addresses certain problems involving the past—issues that may have existed before you purchased the property but were not discovered during the title search.

Depending on the policy and its terms, title insurance can provide protection against certain covered claims or defects affecting ownership of the property.

There are generally two types of title insurance policies involved in a financed residential transaction:

Owner’s Title Insurance

An owner’s title insurance policy protects the buyer’s interest in the property, subject to the policy’s terms, conditions, exclusions, and exceptions.

For many buyers, this provides an additional level of protection and peace of mind when making one of the largest purchases of their lives.

Lender’s Title Insurance

When a buyer finances a property with a mortgage, the lender will typically require a lender’s title insurance policy. This policy protects the lender’s interest in the property against certain covered title-related risks.

The lender’s policy and the owner’s policy serve different purposes, so it is important to understand the distinction between them.

The closing attorney or title professional involved in your transaction can provide specific information about the available policies, coverage, costs, and limitations.

Working With Your Closing Attorney

The period between an accepted contract and closing involves many moving parts. The closing attorney may need information and documentation from the buyer, seller, lender, Realtor, and other parties involved in the transaction.

Our agents work closely with qualified closing professionals to help keep communication moving and make sure important information gets to the appropriate people.

If questions arise, we can help you understand which professional is best equipped to address them. Our goal is to make the process as organized and straightforward as possible while helping you stay informed about what is happening with your transaction.

We believe good communication is especially important as closing approaches. Knowing what documents are needed, what deadlines are approaching, and what to expect at closing can help reduce unnecessary stress.

Preparing for Closing

Before closing, there may be several important items to complete, depending on whether you are buying or selling and whether financing is involved.

These may include:

  • Completing lender requirements
  • Finalizing title work
  • Addressing any title issues
  • Preparing and reviewing closing documents
  • Confirming funds needed for closing
  • Completing required inspections or repairs
  • Coordinating the final walk-through
  • Confirming the closing date, time, and location
  • Making sure all parties have the information needed to complete the transaction

Your Realtor and closing attorney have different responsibilities, but they work together with the other professionals involved to help the transaction reach the closing table successfully.

If you are a buyer, we can help you understand what to expect as you move toward taking ownership of your new property.

If you are a seller, we can help you understand the steps involved in completing the sale and preparing for the transfer of the property.

At the Closing Table

At closing, the buyer and seller will sign the documents necessary to complete the transaction. The closing attorney will oversee the legal closing process and handle the required documents, recording, and disbursement of funds.

For buyers, closing represents the final stage of purchasing the property. Once the transaction has been properly completed and the applicable requirements have been satisfied, ownership is transferred according to the terms of the transaction.

For sellers, closing is the final step in transferring the property to the buyer and completing the sale.

It can be a significant moment—especially after all the searching, preparation, negotiations, inspections, paperwork, and waiting that brought you there.

Our goal is to help you arrive at closing prepared, informed, and confident about the transaction.

A Team Working Together for You

Real estate transactions involve more than a buyer, a seller, and a Realtor. Lenders, inspectors, appraisers, closing attorneys, title professionals, insurance providers, and other specialists may all play important roles depending on the transaction.

At Mavis Lane Realty, we understand the importance of having qualified professionals involved and maintaining good communication throughout the process.

We work closely with qualified attorneys and other professionals to help make sure the real estate transaction progresses properly and that you know what to expect at each stage.

While the closing attorney handles the legal closing process, we remain available to help guide you through the real estate side of the transaction and answer questions along the way.
